1. Acceptance of Terms

By accessing or using JobQuest ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and JobQuest ("we," "us," or "our").

2. Service Description

JobQuest is a job search accountability platform that provides AI-powered tools to help job seekers manage their search. The Service includes:

• Personalized daily and weekly job search plans generated by AI
• Activity tracking and application pipeline management
• ATS resume scoring against job descriptions
• Weekly AI-generated coaching email digests
• Dashboard with metrics and progress tracking

3. Account Responsibilities

When creating and maintaining your account, you agree to:

• Provide accurate, current, and complete information during registration and in your profile.
• Maintain the security of your account credentials. You are responsible for all activity that occurs under your account.
• Maintain only one account per person. Creating multiple accounts to circumvent usage limits or for any other reason is prohibited.
• Notify us immediately at support@jobquest.app if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to:

• Abuse AI features by submitting content that is fraudulent, misleading, or unrelated to job searching (e.g., using the ATS scorer for purposes other than resume evaluation).
• Use automated tools, scripts, bots, or scrapers to access or interact with the Service.
• Share your account credentials with others or allow others to access your account.
• Attempt to circumvent rate limits, usage quotas, or subscription tier restrictions.
• Upload malicious files, viruses, or any content that could harm the Service or other users.
• Use the Service to harass, defame, or infringe upon the rights of others.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.

5. AI-Generated Content Disclaimer

JobQuest uses artificial intelligence to generate job search plans, resume scores, feedback, and coaching content. You acknowledge and agree that:

• AI-generated suggestions, scores, and recommendations are provided for informational purposes only and do not constitute professional career advice, employment counseling, or any form of guarantee.
• AI outputs may contain inaccuracies or may not be suitable for your specific situation. You should use your own judgment when making career decisions.
• Resume scores are estimates based on AI analysis and do not guarantee how any specific applicant tracking system or human recruiter will evaluate your resume.
• We do not guarantee that following AI-generated plans or suggestions will result in job offers, interviews, or any specific outcomes.

6. Subscription and Billing

Free Tier

JobQuest offers a free tier with limited features, including 3 lifetime ATS resume scans. The free tier is available indefinitely and does not require payment information.

Pro Subscription ($25/month)

The Pro subscription provides access to additional features including unlimited ATS scans, full rewrite suggestions, plan rebalancing, and more. Pro subscriptions are billed monthly at $25 USD.

Auto-Renewal

Pro subscriptions automatically renew each billing cycle unless cancelled. You will be charged at the beginning of each billing period.

Cancellation

You may cancel your Pro subscription at any time from your account settings. Upon cancellation, you will retain access to Pro features until the end of your current billing period. After that, your account will revert to the free tier. No refunds are provided for partial billing periods.

Price Changes

We reserve the right to change subscription pricing. If we increase prices, we will notify you at least 30 days in advance via email. Price changes will take effect at the start of your next billing cycle after the notice period.

7. Intellectual Property

Your Data

You retain full ownership of all data you submit to JobQuest, including your profile information, resumes, activity logs, and application data. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service to you.

Our Platform

The JobQuest platform, including its design, code, AI prompts, algorithms, branding, and documentation, is owned by JobQuest and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the platform.

8. Data Export

You may export your data (including activities, applications, and profile information) at any time through your account settings. Exported data is provided in standard CSV format. We believe your data belongs to you, and you should always be able to take it with you.

9. Account Termination

By You

You may delete your account at any time from your account settings. Upon deletion, all your data will be permanently removed from our systems. This action cannot be undone. If you have an active Pro subscription, please cancel it before deleting your account.

By Us

We reserve the right to suspend or terminate your account if you violate these Terms, including but not limited to: abusing AI features, circumventing rate limits, engaging in fraudulent activity, or using the Service in ways that harm other users or the platform. We will make reasonable efforts to notify you before termination, except in cases of severe abuse.

10. Limitation of Liability

To the maximum extent permitted by applicable law, JobQuest and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

JobQuest does not guarantee that using the Service will result in job placement, interviews, offers, or any specific employment outcomes. The Service is a productivity and accountability tool designed to support your job search, not a placement agency or employment service.

We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for any decisions you make based on information provided by the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which JobQuest is incorporated, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via the email address associated with your account at least 14 days before the changes take effect. Your continued use of the Service after the updated Terms become effective constitutes acceptance of the new Terms.
